By accessing and using Friendly Reminder ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

The Service is operated by a Belgian company and is subject to Belgian law and European Union regulations.

2. Description of Service

Friendly Reminder provides automated reminder services including but not limited to:

  • Birthday and event reminders
  • Email notifications
  • SMS notifications (where available)
  • Postcard sending services (where available)
  • Contact management

3. User Accounts

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities under your account

4. Billing and Payment

The Service operates on a credit-based system:

  • Credits are purchased in advance and deducted per message sent
  • All prices are displayed in Euros (EUR) and include applicable VAT
  • Payments are processed securely through Stripe
  • Credits are non-refundable once purchased
  • Unused credits do not expire

In accordance with Belgian consumer protection law, you have the right to withdraw from your purchase within 14 days, except for services already fully performed with your prior consent.

5. User Content and Responsibilities

You are responsible for all content you upload or transmit through the Service. You agree not to:

  • Send spam, unsolicited messages, or harassing content
  • Upload contacts without proper consent
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malicious code or harmful content
  • Impersonate others or misrepresent your identity

6. Data Protection and GDPR Compliance

We are committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR) and Belgian data protection laws. By using the Service:

  • You confirm that you have obtained necessary consent from contacts whose data you upload
  • You acknowledge that you act as a data controller for contact information you provide
  • We act as a data processor when handling your contact data
  • You retain all rights to your data and can request its deletion at any time

7. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue the Service with reasonable notice. We are not liable for any service interruptions, delays, or failures.

8. Intellectual Property

All content, features, and functionality of the Service are owned by us and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by Belgian and EU law:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the last 12 months
  • We are not responsible for third-party services (Stripe, messaging providers)
  • We are not liable for delays or failures in message delivery

This limitation does not affect mandatory consumer rights under Belgian law.

10. Termination

We reserve the right to terminate or suspend your account immediately if you violate these Terms. You may terminate your account at any time through the Service settings. Upon termination, your right to use the Service ceases, but these Terms remain in effect for applicable provisions.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by Belgian law. Any disputes shall be resolved in the competent courts of Belgium.

In accordance with EU regulations, consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

14. Severability

These Terms and Conditions are available in English. In case of any discrepancy between language versions, the English version shall prevail.
